Understanding CC&R Enforcement in Woodgate

We’ve had a few questions submitted to the WNA about how the rules for Woodgate (Covenants, Conditions & Restrictions) are enforced. We want to provide a quick overview to help clear things up:

What are the CC&Rs?

As a reminder, the Woodgate Covenants, Conditions & Restrictions (CC&Rs) were filed in 1983 by the original developer, before any homes were sold. These rules apply to all property owners within Woodgate, and they're the only legally binding guidelines for the neighborhood everyone must abide by.


Who can enforce the CC&Rs?

According to the CC&Rs (see Paragraph 18), any property owner has the right to raise a concern or seek enforcement. This also includes members of the Architectural Control Committee (ACC) and the WNA Board, since they're homeowners too.


With that said, enforcement is very limited. There is no budget for taking legal action (unless it becomes an item voted upon by the WNA and yearly dues are raised significantly to cover such an endeavor). The hope has always been that our fellow neighbors can actually talk to one another in-person and work things out directly and respectfully.


What does the WNA do?

The Woodgate Neighborhood Association (WNA) was formed in 1984. It is:


  • Voluntary. You must choose to join and pay the $75 dues each year.

  • Here to support the ACC and help share information about our neighborhood rules.

  • Here to help and can try to enforce the rules, but is limited by the lack of funding to do so.

  • A place for neighbors to connect, socialize and work together to build a connected community.


What about the City of Carrollton?

The City of Carrollton does not enforce our CC&Rs. They will only step in if something violates city codes and ordinances, like noise, trash, or nuisance issues, tall weeds, etc.


In Short:

  • All property owners in Woodgate must follow the 1983 CC&Rs.

  • Any homeowner (including the ACC or WNA) can raise concerns.

  • The WNA is here to help and can try to enforce the rules, but is limited by the lack of funding to do so. There is no budget for taking legal action (unless it becomes an item voted upon by the WNA and yearly dues are raised significantly to cover such an endeavor).

  • The City of Carrollton only enforces city codes and ordinances, not our neighborhood CC&Rs.
